Terms of Service
These Terms of Service ("Terms") govern your use of the Pins & Presses mobile application and website (the "Service"). By creating an account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction. Where the Service is used to wager money, you must additionally be of legal age to participate in social/skill-based contests in your state or country.
2. Your Account
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Leagues and User Content
You retain ownership of content you post (photos, videos, chat messages, scores). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit that content as necessary to operate the Service. You are solely responsible for the content you post and must not post anything unlawful, harassing, infringing, or that violates another person's privacy.
4. Wagering and Wallet
The Service supports peer-to-peer wagers between members of a private league. Wagers are settled between consenting participants in a skill-based game (golf). You acknowledge that:
- Funds added to your wallet are held by our payment processor (Stripe) and converted to in-app balance.
- A small platform fee (currently 1%) is charged on wagers.
- You are responsible for ensuring your participation is lawful in your jurisdiction. Where local law prohibits or restricts peer-to-peer wagering, do not use the wallet/wager features.
- Wagers, once locked in, are binding. Refunds occur only when a match is cancelled by the commissioner.
5. Payments and Refunds
All payments are processed by Stripe. Wallet top-ups are generally non-refundable except where required by law. Disputed transactions should be reported within 30 days.
6. Acceptable Use
You agree not to: (a) reverse-engineer or interfere with the Service; (b) scrape, copy, or resell data; (c) impersonate another person; (d) use the Service to launder money, defraud other members, or engage in unlawful activity; (e) post content that infringes intellectual-property rights.
7. Termination
We may suspend or terminate your account for violation of these Terms, suspected fraud, or as required by law. You may close your account at any time from within the app. Any remaining wallet balance can be withdrawn to your bank account via Stripe before closure.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or fitness for a particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, Pins & Presses and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of your use of the Service. Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the prior twelve months.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes shall be resolved in the state or federal courts of Delaware.
11. Changes
We may update these Terms from time to time. Material changes will be announced in the app. Continued use after changes constitutes acceptance.
